1. General Terms

5. Order Process and Contract Formation

6. Payment Terms

All financial transactions on LustMonster.com are conducted in the currency shown at checkout. You are solely responsible for covering any associated bank fees, currency conversion costs, or surcharges applied by your payment provider.

7. Prices and Taxes

You are responsible for any additional state, county, or municipal taxes that may apply.
  • All other countries: prices are displayed exclusive of local taxes, duties, or import fees unless explicitly stated. Any applicable local taxes, customs duties, or import charges are your sole responsibility.

We reserve the right to amend prices at any time without prior notice. The price applicable to your order is the price shown at the time of checkout confirmation. In the event of a pricing error, we reserve the right to cancel the order and issue a full refund.

8. Shipping and Delivery

The estimated delivery dates shown during checkout are based on historical averages and current operational forecasts. These are provided solely as a convenience and do not constitute a legally binding guarantee. Factors such as international customs clearance, logistical delays, public holidays, or natural events may impact final delivery timelines.

It is your duty to supply a valid, complete, and accurate shipping address at the time of checkout. We are not responsible for delays or non-delivery due to incorrect recipient information. Any reshipments caused by such errors may incur additional charges.

Ownership and risk pass to the customer at the moment the goods are handed to the courier or carrier. From that point onward, all risks including damage, delay, customs seizure, or import refusal fall on the buyer. Customs duties, import fees, VAT, or other local charges are your sole responsibility unless explicitly stated otherwise.

9. Right of Withdrawal (EU 14-Day Rule)

In accordance with Directive 2011/83/EU on consumer rights, customers residing in the European Union have a legal right to withdraw from their purchase within 14 calendar days of receiving the product, without providing a reason.

This right is strictly limited under Article 16(e) of the directive, which excludes sealed health or hygiene-sensitive products that have been unsealed by the consumer. This exemption applies fully to intimate items and adult toys packaged in sealed wrappers for health protection.

For hygiene reasons, we cannot accept returns of products that have been unsealed, opened, used, or tampered with in any way. To qualify for a return, the item must be in its original, unopened, and undamaged packaging. Contact our customer service within the 14-day window to initiate a return request.

10. Returns, Refunds, and Exchanges

All returns must receive prior written authorisation from our support team. Unauthorised returns will not be accepted or processed. Once authorised, the item must be returned to us within 14 calendar days at your expense, unless otherwise agreed.

Refunds, when applicable, will be processed within 10 business days from the date we receive and inspect the returned item. The refund will be made via the original payment method. If a chargeback is initiated without prior contact with our support team, or if a chargeback is found to be unsubstantiated, fraudulent, or in bad faith, we reserve the right to:

  • Submit documented evidence to your bank or payment provider to dispute the chargeback, including order records, delivery confirmation, and correspondence history.
  • Permanently ban your account and associated payment methods, email addresses, and shipping addresses from future use of our platform.
  • Recover any costs associated with the chargeback process, including administrative fees charged by our payment processor.
  • Pursue legal action for recovery of funds where the chargeback amount and circumstances justify it.

Initiating a chargeback for a product that was delivered as described, or for a return that did not meet our return policy criteria, constitutes fraudulent misrepresentation and may be reported to relevant authorities.

12. Product Warranty and Limitations

We offer a limited 30-day warranty against manufacturing defects on all LustMonster products. This warranty does not cover damage resulting from user misuse, mishandling, cleaning with improper substances, alterations, or wear-and-tear from normal usage.

The warranty is applicable only to the original purchaser and requires proof of purchase. Items found to be defective within the warranty window may be repaired, replaced, or refunded at our discretion.

To the maximum extent permitted by applicable law, we expressly disclaim any and all implied warranties, including merchantability or fitness for a specific purpose. The user assumes all risks associated with the handling and use of fantasy adult products.

13. Marketing Communications

18. Limitation of Liability

To the fullest extent permitted by applicable law, LustMonster and its owners, affiliates, and employees disclaim all liability for:

  • Loss of profits, revenue, anticipated savings, goodwill, or business opportunity.
  • Damages arising from delays, loss of data, website downtime, or product misuse.

Our total aggregate liability under these Terms shall not exceed the total amount paid by you for the specific order giving rise to the claim. This limitation applies whether the claim is based in contract, tort, negligence, strict liability, or otherwise.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability for consequential or incidental damages. If you reside in such a jurisdiction, some of the above limitations may not apply to you to the extent prohibited by applicable law.

19. Dispute Resolution and Arbitration

19.1 Informal Resolution

Before initiating any formal legal proceedings, you agree to contact us at sales@lustmonster.com and attempt to resolve the dispute informally. We will use reasonable efforts to resolve any dispute within 30 days of receiving written notice.

19.2 Binding Arbitration (US Customers)

For customers located in the United States, any dispute, claim, or controversy arising out of or relating to these Terms or the use of our services that cannot be resolved informally shall be resolved by binding individual arbitration administered by a recognised arbitration body (such as the American Arbitration Association (AAA)) under its applicable rules, rather than in court.

You acknowledge and agree that you are waiving the right to a trial by jury and the right to participate in a class action or representative proceeding. The arbitrator may award the same damages and relief as a court, but only in favour of the individual party seeking relief and only to the extent necessary to provide the relief warranted by that party's individual claim.

Arbitration shall take place in English. Either party may seek emergency injunctive relief from a court of competent jurisdiction to prevent irreparable harm pending arbitration. Nothing in this clause prevents either party from seeking relief in small claims court for disputes within that court's jurisdiction.

19.3 Class Action Waiver

To the fullest extent permitted by applicable law, you and LustMonster agree that each party may bring claims against the other only in your or its individual capacity and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding.

19.4 EU Online Dispute Resolution

20. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of England and Wales.

For customers located in the United Kingdom or the European Union: you agree to submit to the non-exclusive jurisdiction of the courts of England and Wales, while retaining the benefit of any mandatory consumer protection rights available under the law of your country of residence.

For customers located in the United States: disputes shall be subject to binding arbitration as set out in Section 19, to the extent permitted by applicable law. Where arbitration does not apply, disputes shall be resolved under the laws of England and Wales in a court of competent jurisdiction.

For customers located in all other countries: disputes shall be resolved under the laws of England and Wales, unless mandatory local consumer protection law in your jurisdiction requires otherwise, in which case your local mandatory law shall apply to the extent required.

Nothing in these Terms limits your rights as a consumer under the mandatory laws of your country of residence.

21. FTC Compliance and Advertising Disclosure

LustMonster operates in compliance with the US Federal Trade Commission (FTC) Act and its associated guidelines on advertising, endorsements, and testimonials. We are committed to truthful, transparent, and non-deceptive commercial practices across all markets.
