General Terms

These Terms and Conditions ("Terms") govern the use of the LustMonster.com website and the purchase of products through our online store. By accessing or using our website, placing an order, or interacting with our services, you agree to be legally bound by these Terms. If you do not agree, you must not use our services.

The website is operated by a legal entity registered in the European Union. For all intents and purposes, "we", "us", or "our" refer to LustMonster, and "you" or "customer" refers to the end-user or purchaser.

These Terms apply globally, except where specifically restricted by law. Any conflicting local consumer protection rights are respected only to the extent they are legally mandatory.

Eligibility

You must be at least 18 years of age, or the age of majority in your local jurisdiction, whichever is higher, to access or use this website and any associated services. By using our website or placing an order, you represent and warrant that you meet the legal requirements for purchasing adult products in your country, state, or province.

We strictly prohibit access to and use of the site by any individuals who do not meet this requirement. We also reserve the right to restrict or block access to users from specific geographic regions or countries, whether due to regulatory constraints, shipping restrictions, or operational limitations. We reserve the right to refuse, cancel, or limit orders for any reason, including but not limited to:

  • legal restrictions in your jurisdiction
  • previous policy violations or abusive behavior

In the event of a cancellation after payment, we will promptly issue a full refund using the original payment method. If a product becomes unavailable after your order has been accepted, we will notify you and provide options for substitution, refund, or credit. We assume no liability for discontinued or out-of-stock items.

Payment Terms

All financial transactions on LustMonster.com are conducted in the currency shown at checkout. You are solely responsible for covering any associated bank fees, currency conversion costs, or surcharges applied by your payment provider. We strongly advise verifying such charges with your bank or card issuer prior to confirming your order.

All payments are securely processed through authorized third-party payment gateways using encrypted protocols. We do not store or directly access your full credit card or debit card numbers at any point. Only tokenized, masked data necessary for transaction verification is handled, and only through secure channels.

An order is not deemed finalized or accepted until full, successful payment has been confirmed. If payment authorization fails, the order is automatically canceled without further obligation or liability from our side. We reserve the right to hold or reject orders with suspicious payment activity or irregular billing information.

Shipping & Delivery

The estimated delivery dates shown during checkout are based on historical averages and current operational forecasts. These are provided solely as a convenience and do not constitute a legally binding promise or guarantee. Factors such as international customs clearance, logistical delays, public holidays, or natural events may impact final delivery timelines.

It is your duty to supply a valid, complete, and accurate shipping address at the time of checkout. We are not responsible for delays or non-delivery due to incorrect recipient information. Any reshipments caused by such errors may incur additional charges.

Ownership and risk pass to the customer at the moment the goods are handed to the courier or carrier. From that point onward, all risks—including damage, delay, customs seizure, or import refusal—fall on the buyer. Customs duties, import fees, VAT, or other local charges are your sole responsibility unless explicitly stated otherwise.

Right of Withdrawal (EU 14-day Rule)

In accordance with Directive 2011/83/EU on consumer rights, customers residing in the European Union have a legal right to withdraw from their purchase within 14 calendar days of receiving the product, without providing a reason.

This right, however, is strictly limited under Article 16(e) of the directive, which excludes sealed health or hygiene-sensitive products that have been unsealed by the consumer. This exemption applies fully to intimate items and adult toys that are packaged in sealed wrappers for health protection.

For hygiene reasons, we cannot accept returns of products that have been unsealed, opened, used, or tampered with in any way. To qualify for a return under this rule, the item must be in its original, unopened, and undamaged packaging. Contact our customer service within the 14-day window to initiate a return request.

Returns, Refunds, and Exchanges

All returns must receive prior written authorization from our support team. Unauthorized returns will not be accepted or processed. Once authorized, the item must be returned to us within 14 calendar days at your expense, unless otherwise agreed.

Refunds, when applicable, will be processed within 10 business days from the date we receive and inspect the returned item. The refund will be made via the original payment method. We do not reimburse original or return shipping costs, except in cases where the item was incorrect or faulty due to our mistake.

If you receive a defective, broken, or damaged item, you must notify us within 48 hours of delivery and provide photo documentation clearly showing the problem. Depending on the situation, we may offer a replacement, store credit, or refund. In some cases, the defective item may need to be returned for quality control before any resolution is issued.

Product Warranty and Limitations

We offer a limited 30-day warranty against manufacturing defects on all LustMonster products. This warranty does not cover damage resulting from user misuse, mishandling, cleaning with improper substances, alterations, or wear-and-tear arising from normal usage.

The warranty is applicable only to the original purchaser and requires proof of purchase. Items found to be defective within the warranty window may be repaired, replaced, or refunded at our discretion. Warranty coverage does not include cosmetic damage or compatibility with other non-LustMonster items.

To the maximum extent permitted by law, we expressly disclaim any and all implied warranties, including merchantability or fitness for a specific purpose. The user assumes all risks associated with the handling and use of fantasy adult products. Use of any product in a manner not in accordance with its intended purpose voids all warranties.

User Conduct and Acceptable Use

You agree to use the LustMonster website and services solely for lawful and authorized purposes. You may not, under any circumstances:

  • Violate any applicable law or regulation in connection with your use of our platform.
  • Use the site to promote or distribute harmful, harassing, defamatory, obscene, or illegal content.
  • Attempt to access, hack, disrupt, or overload our infrastructure, including any denial-of-service attacks.
  • Employ scraping technologies, bots, or automated scripts to extract data or interact with the site.
  • Reproduce, modify, or publicly distribute any of our proprietary content without explicit consent.

Violations of this policy may result in immediate termination of your account, cancellation of pending orders, and referral to legal authorities if necessary. We reserve full discretion in interpreting and enforcing acceptable use policies.

Intellectual Property Rights

All website content—including but not limited to text, graphics, product descriptions, imagery, product names, logos, icons, layouts, video content, audio, code, and digital assets—is either the exclusive property of LustMonster or is used with valid licenses from third-party content owners. All such material is protected under international and local intellectual property laws, including copyright, trademark, and design rights.

Any unauthorized use, copying, modification, distribution, reproduction, transmission, republication, or display of any part of the site or its materials is strictly prohibited. Infringement will be prosecuted to the maximum extent permitted by law.

Account Termination and Suspension

We reserve the right to suspend, restrict, or terminate your account or access to our services at any time, with or without prior notice, under the following non-exhaustive circumstances:

  • Attempts to circumvent payment protocols, initiate chargebacks without valid grounds, or manipulate our refund policies.
  • Breach of any section of these Terms, including misuse or resale of products.
  • Use of automated tools or bots to scrape, overload, or interfere with our website infrastructure.
  • Any behavior deemed abusive, harassing, threatening, or intended to exploit the site, its users, or staff.

Pending orders associated with terminated accounts may be canceled and refunded at our sole discretion. We are under no obligation to provide a reason for termination where local law permits discretion.

Limitation of Liability

To the fullest extent permitted by applicable law, LustMonster and its owners, affiliates, and employees disclaim all liability for:

  • Indirect, incidental, special, punitive, or consequential damages.
  • Loss of profits, revenue, anticipated savings, goodwill, or business opportunity.
  • Damages arising from delays, loss of data, website downtime, or product misuse.

Our total aggregate liability under these Terms shall not exceed the total amount paid by you for the specific order giving rise to the claim.

This limitation shall apply whether the claim is based in contract, tort, negligence, strict liability, or otherwise—even if advised of the possibility of such damages.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of Bulgaria. In the event of any dispute arising out of or in connection with these Terms, you agree to submit to the exclusive jurisdiction of the competent courts of Sofia, Bulgaria.

If you are a consumer residing in the EU, you may also benefit from mandatory provisions of your local consumer protection laws. Nothing in these Terms affects your statutory rights as a consumer.

Amendments and Severability

We reserve the right to modify, amend, or update these Terms at any time without prior notice. Any such changes will become effective upon posting the updated Terms on this page, accompanied by a visible revision date.

You are responsible for reviewing the Terms periodically. Continued use of the site after modifications constitutes your binding acceptance of the revised Terms.

If any provision of these Terms is held to be invalid, illegal, or unenforceable, such provision shall be severed, and the remaining provisions shall remain valid and enforceable to the fullest extent permitted by law.
